Will my kids be responsible for my debt after my death?

Latest News

Many parents believe that when they die their debts will pass to their children. This is usually a big concern for parents because they do not want their kids responsible for their debts.

Generally when you die your assets become a part of your estate. During the probate process your assets and debts will be handled. The probate court will determine how to distribute your assets according to your will or state law if no will.

The probate court will pay your debts with any money or assets in the estate.  If you have more debt than property, you children will not receive anything from the estate.
